This website is directed to all persons who own, owned, rent, rented and/or ordinarily resided in one of the 417 residential condominium units in the condominium known as X Condos and their family members and guests, located at 110 Charles Street East in Toronto during the Class Period from November 8, 2010 to September 5, 2023 and who have not signed a full and final release in favour of the Defendants, Great Gulf Homes Limited, Great Gulf (Jarvis-Charles) Ltd. and Jarvis-Charles G.P. Inc ("Eligible Class Members"). The excluded owner(s) and/or tenant(s) who owned or rented a unit who are not eligible to participate in this settlement because she, he or their predecessor signed a Release can be found here in Section A.
The parties have entered into a settlement agreement dated August 1, 2023 (the “Settlement Agreement”) which was approved on February 8, 2024. The Defendants will pay $1,000,000 (“Settlement Trust”), inclusive of prejudgment interest to settle the claims of the Class Members, including the legal fees and disbursements and the costs of administering the settlement in return for a release and a dismissal of the class action. Inc., you are an Eligible Class Member.
Summary of Settlement Benefits
Class Members shall submit Claim Forms to the Claims Administrator, who will determine the amounts to be distributed to Class Members from the Settlement Fund, in full and final settlement of their claims.
Eligible Class Members will receive an award calculated on the amount of the settlement fund remaining after payment of legal fees, payments of honoraria, disbursements, and taxes thereon and administrative expenses for the settlement administration (the “Net Settlement Fund”). The claims administrator will calculate awards on a per unit basis. There are three claim categories in which Class Members may be eligible. Category A awards all Class Members who submit a valid claim an award of about $1,500 per unit, while Category B will award Class Members reimbursement for the cost to repair or replace the Pressure Balanced Valve. Lastly, Category C will award Class Members who sustained an injury arising from the unpredictable temperature fluctuations, an award of about $2,000 with proper documentation.
